By accessing or using bAIb ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

bAIb is an AI-powered companion and dating practice application. Our Service provides:

• AI-generated personas for conversation and companionship
• Dating practice simulations with feedback
• Memory features that personalize your experience

IMPORTANT: All personas on bAIb are artificial intelligence programs, not real people. Conversations are generated by AI and should not be considered professional advice of any kind.

3. Eligibility

You must be at least 18 years old to use bAIb. By using our Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. User Accounts

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate and complete information

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to manipulate or abuse the AI systems
• Share content that is harmful, threatening, or harassing
• Impersonate any person or entity
• Attempt to access other users' accounts or data
• Use automated systems to access the Service without permission
• Reverse engineer or attempt to extract our AI models

6. Subscriptions and Payments

bAIb offers both free and premium subscription plans. For premium subscriptions:

• Payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled
• You may cancel at any time through your account settings
• Refunds are provided in accordance with our refund policy
• Prices may change with 30 days notice

7. Proprietary Content & Intellectual Property

All content, features, and functionality of bAIb are the exclusive proprietary property of bAIb and are protected by copyright, trademark, and other intellectual property laws. This includes but is not limited to:

• All AI persona names, biographies, personality profiles, and backstories
• All AI-generated images, videos, and animations depicting personas
• All conversation system prompts, behavioral instructions, and AI personality frameworks
• The unique combination and presentation of persona attributes
• The bAIb brand name, logo, and all associated trademarks
• All software, algorithms, and technical implementations

No part of the Service's proprietary content may be reproduced, distributed, modified, displayed, performed, scraped, harvested, or used in any derivative work without the prior written consent of bAIb. You may not create competing products or services using bAIb's personas, character designs, or content. Unauthorized use, reproduction, or distribution of any proprietary content may result in civil and criminal penalties.

8. AI Limitations and Disclaimers

You acknowledge and agree that:

• AI personas are not real people and cannot form genuine relationships
• AI responses may occasionally be inaccurate, inappropriate, or nonsensical
• The Service is not a substitute for professional mental health care, therapy, or counseling
• bAIb does not provide medical, legal, financial, or professional advice
• You should not rely on AI personas for important life decisions

9. Mental Health Resources

While bAIb is designed to be a positive experience, we recognize that some users may experience difficult emotions. If you are in crisis or experiencing thoughts of self-harm, please contact emergency services or a crisis helpline immediately. Our Service includes crisis resource information, but this is not a substitute for professional help.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, bAIb SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to bAIb in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless bAIb, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration.
